TERMS OF SERVICE

1. Agreement to Terms

By booking a photography session with TrueYou Headshots, you agree to abide by these Terms of Service. These terms govern the services provided and the rights and responsibilities of both the client and TrueYou Headshots. It is the client's responsibility to read and understand these terms before booking. Any exceptions to these terms must be agreed upon in writing.

2. Photo License & Usage Rights

Clients receive a non-exclusive, non-transferable license to use the final edited images for personal and professional use, including but not limited to LinkedIn, corporate websites, and marketing materials. TrueYou Headshots retains full copyright to all images, meaning that clients may not sell, transfer, or claim ownership of the photos. TrueYou Headshots reserves the right to use images for promotional, marketing, and portfolio purposes unless the client submits a written request for privacy before the session. Unauthorized reproduction, resale, or modification of the photos without explicit written permission is prohibited.

3. Confidentiality

All personal and business information shared with TrueYou Headshots will remain confidential and will not be shared with third parties without the client’s consent, except when required by law. This includes all booking details, communications, and any sensitive or proprietary information disclosed during the session. TrueYou Headshots values the privacy of all clients and ensures that any private or corporate headshots are handled with discretion.

4. Guaranteed Satisfaction

TrueYou Headshots is committed to providing a high-quality experience and strives for 100% client satisfaction. If a client is not satisfied with their photos, they must communicate their concerns within 7 days of receiving their final images. A one-time complimentary re-edit may be offered to address minor retouching concerns. If dissatisfaction persists, a one-time reshoot may be offered at the discretion of the photographer, provided the client has not altered the original images in any way.

5. Cancellation & Refund Policy

Cancellations must be made in writing via email. Refunds are issued based on the following schedule:

• 30 days before the session: 100% refund

• 7-30 days before the session: 50% refund

• 3-6 days before the session: 25% refund

• 3 days or less: No refund

Rescheduling may be available at no additional cost if requested at least 48 hours in advance. If a session is canceled due to unforeseen circumstances on the part of TrueYou Headshots, the client will be offered a full refund or a rescheduled session at no additional cost.

6. Travel Costs

For projects requiring travel outside of the Rochester, NY area, additional fees for travel time, mileage, accommodation, meals, and other necessary expenses will apply. Travel expenses will be estimated in the project quote and adjusted based on actual costs. All travel related expenses will be billed at cost. Clients may choose to handle travel arrangements directly or approve costs coordinated by TrueYou Headshots. Any unforeseen expenses will be communicated for prior approval.

7. AI Protection Policy

TrueYou Headshots does not permit the unauthorized use of AI tools to manipulate or distribute images in a way that misrepresents the original work. Clients may not use AI-generated alterations that change facial features beyond standard retouching, such as deepfake modifications, AI-driven reconstructions, or automated enhancements that significantly alter identity. The intent of the headshot should remain authentic and true to the client’s appearance.

8. Late Arrival Policy

Clients are expected to arrive on time to ensure a smooth and efficient session. Arrivals beyond this time may result in a shortened session without a refund, as sessions are booked back-to-back. If a client arrives more than 20 minutes late, their session may be canceled and rescheduling will be subject to availability and an additional fee.

9. Minors

Clients under the age of 18 must be accompanied by a parent or legal guardian, who must remain present for the duration of the session. The guardian is required to sign a consent form prior to the session. TrueYou Headshots does not photograph minors without proper documentation and oversight.

10. Health & Safety

To ensure a safe environment, clients experiencing illness, fever, or flu-like symptoms should reschedule their session. The studio maintains high hygiene standards, and equipment is sanitized regularly. Clients who arrive visibly unwell may be asked to reschedule their session at no penalty. TrueYou Headshots reserves the right to refuse service if health risks are present.

11. Photo Storage & Delivery

Final images will be delivered digitally via a secure online gallery within 1-7 business days. Clients will receive high-resolution and web-optimized versions of their headshots. TrueYou Headshots retains backups for 30 days from the date of delivery; after that, image retrieval may be subject to an additional archival fee. Clients are encouraged to download and store their images promptly to avoid loss.

12. Liability

TrueYou Headshots is not responsible for any personal injury, property damage, or unforeseen circumstances that may occur during or after the session. Clients assume full responsibility for their safety and well-being while on location. The photographer will take all reasonable precautions to ensure a safe and comfortable environment.

13. Agreement Changes

TrueYou Headshots reserves the right to update these Terms of Service at any time. Clients will be notified of any significant changes, and continued use of services constitutes acceptance of the revised terms. It is recommended that clients review these terms periodically for updates.
